By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Service.

• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

• Paid features may be offered on a subscription basis. Prices, features, and terms will be disclosed at checkout. Taxes may apply.
• Unless otherwise stated, subscriptions auto-renew until canceled. You can cancel at any time to prevent future charges. Fees already paid are generally non-refundable except where required by law.
• We may change prices or features with prior notice as required by law. Continued use after changes take effect constitutes acceptance of the new terms.

You retain ownership of content you submit to the Service ("User Content"). You grant RoundByRound a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, create derivative works, publish, and display your User Content solely for operating and improving the Service.

You represent that you have all rights necessary to grant this license and that your User Content does not infringe any third-party rights or violate any law.

RoundByRound may allow you to upload or submit images and other media related to fighters (for example, profile photos, highlight images, or other artwork) through dedicated tools or submission flows (collectively, "Fighter Media").

• Rights & permissions. By uploading Fighter Media, you represent and warrant that:
  • You own the content or have all necessary rights, licenses, and permissions to upload it and grant the licenses described in these Terms.
  • The Fighter Media does not consist of broadcast screenshots, copyrighted photographs, or other protected works used without permission from the rightsholder.
  • You have any required permissions or consent to use the depicted individual’s name, image, and likeness, where applicable.
• License to RoundByRound. In addition to the User Content license above, you grant RoundByRound a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, crop, resize, modify, display, and distribute Fighter Media in connection with the Service, including on fighter profile pages, feeds, highlight sections, promotional materials for RoundByRound, and via our CDN or hosting providers.
• Moderation & removal. We may review, approve, reject, or remove Fighter Media at our discretion, including where we believe it:
  • Violates these Terms or our policies;
  • Infringes or is alleged to infringe the rights of a third party;
  • Contains nudity, graphic violence, harassment, hate, or other inappropriate content; or
  • Misrepresents or impersonates a fighter, brand, or other third party.
• No guarantee of display. Submitting Fighter Media does not guarantee that it will be displayed on the site. We may limit the number or type of images shown, or remove Fighter Media at any time for any reason.
• Reporting issues. If you believe Fighter Media on the Service infringes your rights or the rights of someone you represent, contact us at [email protected] with sufficient detail for us to review and address the issue.

You agree not to do any of the following:

• Use the Service for any unlawful purpose or to encourage unlawful activity.
• Scrape, crawl, harvest, or access the Service via automated means without prior consent.
• Attempt to breach, probe, or test the vulnerability of any system or network.
• Reverse engineer, decompile, or attempt to derive source code or underlying algorithms.
• Upload malicious code, interfere with the Service, or bypass security measures.
• Infringe or violate intellectual property, privacy, or other rights of others.
• Use the Service to spam, phish, or engage in deceptive or fraudulent activities.

• RoundByRound publishes advanced MMA statistics, ratings, leaderboards, and projections for informational and entertainment purposes only. Performance metrics are not guarantees of future results.
• The Service does not provide financial, investment, or betting advice. Any decisions you make using information from the Service are made at your own risk. If you choose to participate in sports betting, do so responsibly and in accordance with applicable laws in your jurisdiction.
• Data sources may include third parties. We strive for accuracy but do not warrant that all information is complete, current, or error-free.

The Service, including all content, software, visual interfaces, graphics, and trademarks, is owned by or licensed to RoundByRound and is protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, create derivative works of, distribute, or otherwise exploit the Service or its content.

The Service may contain links to third-party websites or services that are not owned or controlled by RoundByRound. We are not responsible for their content, policies, or practices. Access such sites at your own risk and review their terms and privacy policies.

• THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
• RoundByRound DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.
• ASPECTS/ASSETS CONTAINED ON THIS SITE MAY BE AI GENERATED. NOTHING ON THIS SITE SHOULD BE TAKEN AS FACT UNLESS STATED OTHERWISE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RoundByRound AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF THE SERVICE.

You agree to indemnify and hold RoundByRound harmless from any claims, liabilities, damages, losses, and expenses, including reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service, your User Content, or your violation of these Terms.

We may suspend or terminate your access to the Service at any time for any reason, including if we reasonably believe you have violated these Terms. Upon termination, your right to use the Service will cease immediately. Sections that by their nature should survive termination shall survive (e.g., IP, disclaimers, limitations of liability, indemnification, and governing law).

These Terms and any dispute arising out of or relating to them shall be governed by the laws of the United States of America, without regard to its conflict of law provisions. You agree to the exclusive jurisdiction and venue of the courts located in that jurisdiction for the resolution of any dispute.

We may update these Terms from time to time. If changes are material, we will provide notice as required by law. The updated Terms will be effective as of the date indicated above. Your continued use of the Service after the effective date constitutes acceptance of the changes.
